A data breach is usually followed within weeks by class actions in federal court, and years later, sometimes, by a settlement with a claim form and a deadline. The two stages are often confused, and the confusion is what the scam sites feed on: a lawsuit filed last month gives nobody a payout today.

- Does a data breach lawsuit mean I will get money?
- Not by itself. A filed complaint contains allegations that have not been tested; there is no claim form and often no resolution for years. Money comes only from a court-approved settlement with a claim deadline, which the stage column marks separately.
- What proves I am part of a data breach class?
- The breach notification letter, in most settlements. Keep it, along with receipts for anything you spend because of the breach, such as credit monitoring or card replacement fees.
- What do data breach settlements typically pay?
- Reimbursement of documented out-of-pocket losses up to a cap, sometimes a set rate for documented time, a small flat payment for people with no documented loss, and credit monitoring for a fixed number of years.
