Illinois has its own WARN Act, and it reaches smaller employers than the federal law. The Illinois Worker Adjustment and Retraining Notification Act applies to businesses with 75 or more full-time employees and requires 60 days' written notice before a plant closing or mass layoff, given to the affected workers, to the Department of Commerce and Economic Opportunity and to the chief elected officials of the city and county. A plant closing counts when 50 or more full-time employees at one site lose their jobs within 30 days; a mass layoff counts at 25 or more, if they are at least 33 percent of the site's full-time employees, or at 250 or more. The federal WARN Act starts at employers of 100. Owners of investor-owned power plants and coal mines must give two years' notice.

The department publishes the notices it receives in a monthly report on Illinois workNet. This page lists every new notice in the 2026 reports, January through August: 90 notices covering 16,662 workers, newest first. 67 are closings, 22 are layoffs and one, Hawthorne Race Course in Stickney, is a possible closing. The largest is the Tyson Foods meat processing plant in Hillsdale, Rock Island County: 2,495 workers, in a notice received on August 13 for a closing on October 12. Next come Franciscan Alliance's Franciscan Health Olympia Fields hospital, 1,535 workers, and a staffing company, Ideal US Talent Worker OpCo, 1,395 workers across five northern Illinois counties. Notices for sites in Cook County alone account for 6,911 of the workers, about 41 percent.

Each report also carries supplemental notices that change an earlier filing, and those are not added to the totals here. The largest in 2026 came from Capital One in Riverwoods, which added at least 276 workers in June and at least 431 in August to a notice first filed in August 2025, and from Spirit Airlines at O'Hare, which added 292 workers in May.

How WARN notices work explains what a notice must contain and what a worker can claim when it is not given. The WARN notices by state tracker links every state's listing, California WARN notices is the same page for California, and how to file for unemployment covers the claim that comes after the last day.

Read on September 15, 2026 from the eight 2026 monthly WARN reports, January to August, published by the Illinois Department of Commerce and Economic Opportunity on Illinois workNet. Each new notice is listed once; a Heartland Human Care Services notice of April 1 that appears in both the March and April reports is counted once. Counts, dates and causes are the employer’s figures as the report prints them. Some first layoff dates fall before the notice date, and the February 17 Heartland notice gives April 1, 2025; where a report gives a date “or within 14 days after”, the first date is shown. Republic National Distributing’s June 18 notice covers 180 workers at Niles and 100 at Romeoville. Supplemental notices are described above but not added to the totals. The statute was read from the Illinois General Assembly’s pages in their Internet Archive copies.Download CSV

What to do

  1. Open the monthly report for the month your employer filed; each row gives the site address, the first and last layoff dates and the number of workers. illinoisworknet.com
  2. File the unemployment claim in the week the job ends; the notice period is paid work, and benefits start after it.
  3. If you were not given 60 days’ notice, the Illinois Department of Labor takes WARN complaints; it says an employer that fails to give notice owes back pay and benefits for up to 60 days. labor.illinois.gov
  4. A WARN notice also starts the state’s Rapid Response services for the affected workers; the department’s WARN page lists the contact. dceo.illinois.gov

Questions readers ask

Who has to give a WARN notice in Illinois?
An employer with 75 or more employees, not counting part-time workers, or 75 or more employees who together work at least 4,000 hours a week. It must give 60 days’ written notice before a plant closing that costs 50 or more full-time employees their jobs at one site within 30 days, or a mass layoff of at least 25 full-time employees who are at least 33 percent of the site’s full-time employees, or of 250 or more. The notice goes to the workers or their union, to the Department of Commerce and Economic Opportunity and to the local chief elected officials.
How is the Illinois WARN Act different from the federal WARN Act?
It covers smaller employers and smaller layoffs. The federal Act applies to employers of 100 or more and counts a mass layoff at 50 to 499 workers who are at least 33 percent of the site, or 500 or more. The Illinois Act applies from 75 full-time employees and counts a mass layoff at 25 workers who are at least 33 percent of the site, or 250 or more. Both require 60 days’ notice, and Illinois requires two years from owners of investor-owned power plants and coal mines.
Where are Illinois WARN notices published?
The Department of Commerce and Economic Opportunity publishes a monthly WARN report on Illinois workNet, with reports going back to 1999. Each lists the employer, site address, county, type of event, the date the notice was received, the first and last layoff dates and the number of workers. The department says the reports reflect only layoffs employers reported under the WARN Act, not all layoff activity, and that some details cannot be verified before a report is posted.
What happens if an Illinois employer does not give notice?
The Illinois Department of Labor says an employer that fails to give the notice owes each affected employee back pay and benefits for the period of the violation, up to 60 days. Failing to notify the state and local officials also carries a civil penalty of up to $500 for each day, which the statute waives if the employer pays the affected employees what it owes within three weeks of ordering the layoff. The department takes complaints on its WARN page.
Why do some Illinois WARN notices give dates in 2027 and 2028?
Illinois requires owners of investor-owned electric generating plants and coal mines to give two years’ notice instead of 60 days. Vistra Corp. filed notices on May 4, 2026 for its Baldwin, Kincaid and Newton power plants, 304 workers in all, with closing dates from October 2027 to February 2028.
